2. Personal information we collect
The categories of personal information we may collect depend on how you interact with us:
- Contact details — name, billing and shipping address, email address, telephone number.
- Order information — the items you buy, sizes selected, order value, order history, gift messages, and the shipping details you provide.
- Payment information — payment card or other payment details are collected and processed by our payment processors. We do not store full payment card numbers on our systems; we receive limited information such as the payment method type, the last digits of the card, and whether the payment succeeded.
- Account information — if you create a customer account, your login details and saved preferences.
- Customer service information — the content of your emails, messages, returns requests, and any information you choose to give us when you contact us.
- Marketing information — your subscription status and preferences for email or SMS messages, and how you interact with those messages.
- Reviews and user content — reviews, ratings, photographs, and other content you submit to us or post about us, together with any name or initials you choose to display.
- Device and usage information — IP address, browser type and language, device identifiers, operating system, referring pages, the pages you view on the Site, search terms, and time stamps.
You are not required to give us personal information. If you choose not to, we may be unable to process your order, respond to your enquiry, or provide part of the Site.
3. How we collect personal information
- Directly from you — when you place an order, create an account, sign up for emails or texts, leave a review, or contact us.
- Automatically — through cookies, pixels, tags, software development kits and similar technologies used on the Site. See "Cookies and similar technologies" below.
- From service providers and partners — such as our ecommerce platform, payment processors, shipping carriers, marketing and analytics providers, and review platforms, which pass us information about your orders, deliveries and interactions.
4. How we use personal information
- To process, fulfil, ship and deliver your orders, and to handle returns, exchanges and refunds.
- To communicate with you about your orders, including confirmations, shipping notices and delivery problems.
- To provide customer service and respond to your requests.
- To create and manage your customer account.
- To send you marketing communications where you have asked to receive them or where permitted by law, and to measure how those communications perform.
- To display and moderate reviews and other content you submit.
- To operate, maintain, secure and improve the Site, and to understand how it is used.
- To advertise our products, including through advertising delivered on other websites and apps.
- To detect, investigate and prevent fraud, abuse, and other unlawful or prohibited activity, and to protect the rights, property and safety of our customers, our business and others.
- To comply with legal obligations, including tax, accounting, consumer protection and product safety obligations, and to establish, exercise or defend legal claims.
5. How we disclose personal information
We do not sell personal information for money. We may disclose personal information in the following circumstances:
- Service providers. To companies that perform services for us, such as our ecommerce platform, hosting, payment processing, fraud prevention, shipping and fulfilment, customer service, email and SMS delivery, review collection, and analytics. They are permitted to use the information only to provide those services to us.
- Advertising and analytics partners. To partners that help us advertise our products and measure performance. Depending on where you live, this may be considered a "sale" of personal information, "sharing" for cross-context behavioural advertising, or "targeted advertising". See section 7 and our Your Privacy Choices page.
- Legal and safety reasons. Where we believe disclosure is required by law, regulation, legal process or governmental request, or is necessary to protect the rights, property or safety of any person, or to enforce our terms.
- Business transfers. In connection with a merger, financing, acquisition, reorganisation, bankruptcy, or sale of all or part of our business or assets.
- With your direction or consent. Where you ask us to share information or agree to us doing so.
6. Our relationship with our ecommerce platform
The Site is hosted on Shopify, which provides the online platform that allows us to sell our products to you. Shopify stores your data on its servers and processes it in order to provide the platform to us, and also uses certain information as an independent controller for its own purposes, as described in Shopify's own privacy policy. Payments made through the Site are processed by Shopify and by the payment providers you select at checkout.
7. Cookies, similar technologies, and targeted advertising
We and our partners use cookies, pixels, tags and similar technologies to operate the Site, remember your cart and preferences, measure how the Site is used, and show you advertising that is more relevant to you.
Sharing personal information with advertising partners based on your activity across different websites may be considered a "sale", "sharing" or "targeted advertising" under certain U.S. state privacy laws. Where the law gives you the right to opt out of those activities, you may do so on our Your Privacy Choices page.
Global Privacy Control. If you visit the Site with the Global Privacy Control (GPC) opt-out preference signal enabled, and you are in a jurisdiction where that signal must be honoured, we will treat it as a request to opt out of activity that may be considered a "sale" or "sharing" of personal information for the browser and device you are using.
You can also set most browsers to refuse or delete cookies. If you do, parts of the Site may not work as intended.
8. Third-party websites and links
The Site may contain links to websites and services we do not operate, including social media platforms and marketplaces. We are not responsible for their privacy practices. We encourage you to read the privacy policy of any site you visit.
9. Children's privacy
We sell children's clothing, but the Site is intended for adults. The Site is not directed to children, and we do not knowingly collect personal information from children under 13 years of age. Purchases must be made by an adult. If you believe a child has provided us with personal information, please contact us at the address in section 14 and we will take steps to delete it. We do not knowingly "sell" or "share" the personal information of consumers under 16 years of age.
10. Security and retention
We take reasonable steps to protect personal information against loss, misuse and unauthorised access. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping any account password confidential.
We keep personal information for as long as we need it for the purposes described in this Privacy Policy — for example, for the life of your customer account, to complete and support your orders, and afterwards for as long as required to meet our legal, tax, accounting, product safety and record-keeping obligations, to resolve disputes, and to enforce our agreements.
11. Your privacy rights
Depending on where you live, you may have some or all of the following rights in relation to your personal information:
- Right to know or access — to confirm whether we process your personal information and to obtain a copy of it, including the categories collected, the sources, the purposes, and the categories of recipients.
- Right to portability — to receive your personal information in a portable format, where technically feasible.
- Right to correct — to have inaccurate personal information corrected.
- Right to delete — to ask us to delete personal information we hold about you, subject to exceptions permitted by law.
- Right to opt out — of the "sale" or "sharing" of personal information, of targeted advertising, and of certain profiling.
- Right to limit the use of sensitive personal information, where applicable.
- Right to non-discrimination — we will not deny you goods or services, charge you a different price, or provide a different level of quality because you exercised a privacy right.
- Right to withdraw consent — where we rely on your consent, you may withdraw it at any time. Withdrawal does not affect processing carried out before you withdrew.
How to exercise your rights. Send your request to info@shopjowi.com or write to the postal address in section 1. To opt out of targeted advertising, use our Your Privacy Choices page.
Verification. Before we act on a request, we need to verify that the request comes from you. We may ask you to confirm information already in our records, such as the email address used on an order. We will not ask for more information than is necessary.
Authorised agents. You may use an authorised agent to submit a request on your behalf. We may ask the agent for proof that you gave them written permission, and we may ask you to verify your own identity directly with us.
Timing and appeals. We will respond within the period required by applicable law. If we decline your request, you may appeal that decision by replying to our response or by contacting us at the address in section 14, explaining why you believe the decision should be reconsidered. We will inform you in writing of the outcome of the appeal and, where required, of how to contact your state attorney general.
12. Additional information for residents of certain U.S. states
Some U.S. states — including California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon and others — give residents specific privacy rights. Those laws apply to a business only when the business meets the thresholds set out in each law. Where a law applies to us, we will honour the rights it gives you. Where it does not, we will still handle requests described in section 11 in accordance with this Privacy Policy.
California. California residents may request the categories of personal information we collected, the categories of sources, the business purposes for collecting it, the categories of third parties to whom we disclosed it, and the specific pieces of personal information we hold. California residents may also request deletion and correction, and may opt out of the "sale" or "sharing" of personal information. Under California's "Shine the Light" law, California residents may request information about disclosures of personal information to third parties for their direct marketing purposes.
Nevada. Nevada residents may submit a verified request directing us not to sell certain personal information as defined under Nevada law.
To exercise any of these rights, use the contact details in section 14.
13. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for legal, operational or regulatory reasons. When we do, we will change the "Last updated" date at the top of this page and, where required by law, give you additional notice.
