Overview
shopjowi.com (the "Site") is operated by Omari Group LLC ("JOWI", "we", "us" or "our"). These Terms of Service (the "Terms") govern your access to and use of the Site and any purchase you make through it.
By visiting the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site. Our Privacy Policy, our Shipping Policy, our Return & Refund Policy and our Intellectual Property & User Content Policy are part of these Terms.
1. Who may use the Site
You may use the Site and place orders only if you are at least 18 years old, or the age of majority in your state, and able to enter into a binding contract. The Site is not directed to children. Our products are made for children, but they must be bought by an adult.
We currently sell to customers in the United States. Availability of the Site elsewhere is not a representation that our products are appropriate or available in other jurisdictions.
2. Your account
You may be able to create a customer account. You are responsible for the accuracy of the information in your account, for keeping your login details confidential, and for all activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission.
3. Products, descriptions and images
We try to describe and show our products accurately. Even so, we do not warrant that product descriptions, sizing information, images or other content on the Site are complete, current or error-free. Colours and finishes shown on the Site depend on your screen and may differ from the product as delivered. Prints are cut individually, so the exact placement of a print on a garment varies from one item to the next.
Products may be limited in quantity and may be discontinued at any time. Where a product is offered in limited quantities, we may limit the quantity sold per person, per household or per order.
The information that governs the care, composition and safe use of any garment is the information on the labels attached to that garment and on its packaging. Where anything on the Site differs from those labels, the labels govern.
4. Sizing information
Any size chart, size finder, fit note or size recommendation on the Site is offered as general guidance only. It is not a guarantee of fit. Children of the same age vary widely in height and weight, and sizing differs between brands. You are responsible for choosing the size you order.
5. Product safety and intended use
Follow the care and use instructions on each garment's labels and packaging. Inspect garments before each use and stop using any garment that is damaged, worn through, or missing a fastening.
Sleep safety is a matter for you and your paediatrician. Nothing on the Site is medical advice, and nothing on the Site should be relied on as advice about safe infant sleep.
6. Prices, taxes and billing
Prices are shown in U.S. dollars and do not include taxes or shipping charges unless we say otherwise. Applicable sales tax and shipping are calculated and displayed at checkout before you confirm your order.
We may change prices, promotions and product offerings at any time without notice. A change in price does not affect an order we have already accepted.
You agree to provide current, complete and accurate purchase and account information for every purchase, and to update it promptly so that we can complete your order and contact you if we need to.
7. Orders, acceptance and cancellation
Your order is an offer to buy. A confirmation email acknowledges that we received your order; it is not acceptance of it. The contract is formed when we accept your order, which we do when we ship it.
We may refuse or cancel any order, in whole or in part, at any time. Reasons include a product being unavailable, an error in the price or description of a product, a suspected fraudulent or unauthorised transaction, an order that appears to be placed by a reseller, or an order that breaches these Terms. If we cancel an order after you have been charged, we will refund the amount charged for the cancelled items.
Once an order has entered fulfilment we may be unable to change or cancel it. Requests to change an order must be sent to us as soon as possible using the contact details below.
8. Errors, inaccuracies and omissions
Content on the Site may occasionally contain typographical errors, inaccuracies or omissions, including in relation to price, availability, product descriptions, promotions and delivery estimates. We may correct any error and change or update information at any time without prior notice, including after you have submitted an order. Where a product is listed at an incorrect price, we may cancel the order and refund you.
9. Shipping, returns and refunds
Delivery of your order is governed by our Shipping Policy. Returns, exchanges and refunds are governed by our Return & Refund Policy. Both policies form part of these Terms and are available on the Site.
Risk of loss and title for products pass to you on delivery to the carrier, unless applicable law provides otherwise.
10. Promotions, discounts and gift cards
Promotions, discount codes and gift cards may be subject to their own terms, which we will make available when we offer them. Unless we say otherwise, promotions cannot be combined, cannot be applied to a completed order, and have no cash value. We may withdraw or modify a promotion at any time.
11. Reviews, feedback and user content
If you send us reviews, photographs, comments, suggestions or other content, our Intellectual Property & User Content Policy applies. That policy explains the rights you give us, what you promise about the content you send, and how we handle reviews.
We are under no obligation to keep any submission confidential, to pay compensation for it, or to respond to it. We may edit, remove or decline to publish content that breaches that policy.
12. Intellectual property
The Site and its content — including text, graphics, photographs, illustrations, prints and patterns, logos, layout and code — are owned by or licensed to Omari Group LLC and are protected by intellectual property laws. Our Intellectual Property & User Content Policy sets out what you may and may not do with them.
13. Prohibited uses
You may not use the Site:
- for any unlawful purpose, or to ask anyone else to perform or take part in an unlawful act;
- to breach any law, regulation, rule or ordinance;
- to infringe our intellectual property rights or those of anyone else;
- to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate;
- to submit false or misleading information, including false reviews or reviews of products you have not used;
- to upload or transmit viruses or any other code that will or may affect the operation of the Site or of any related website;
- to collect or track the personal information of others;
- to send unsolicited advertising, spam, phishing messages or similar;
- to scrape, crawl or harvest the Site or its content by automated means without our written permission;
- to buy products for commercial resale without our written permission;
- to interfere with or circumvent the security features of the Site or of any related website.
We may terminate your use of the Site for breaching any of these prohibitions.
14. Third-party tools, links and services
The Site may give you access to third-party tools, content and links that we neither monitor nor control. We provide them "as is" and "as available", without warranties of any kind, and we are not liable for anything arising from your use of them. Your use of a third-party tool or website is at your own risk, and is governed by that third party's own terms and privacy policy.
15. Relationship with our ecommerce platform
The Site is hosted on Shopify, which provides the online platform that allows us to sell our products to you.
16. Disclaimer of warranties
Except where prohibited by law, the Site and everything we deliver to you through it is provided "as is" and "as available", without any warranty of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that any defect will be corrected.
Nothing in this section limits any warranty or remedy that cannot be excluded or limited under applicable law, and nothing in these Terms limits your rights under applicable consumer protection or product safety law.
17. Limitation of liability
To the fullest extent permitted by law, Omari Group LLC and its members, managers, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data or loss of goodwill, arising out of or in connection with your use of the Site or any product bought through it, whether based in contract, tort, strict liability or otherwise, and whether or not we were advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability arising out of or in connection with the Site or any product bought through it will not exceed the amount you paid for the product giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
18. Indemnification
You agree to indemnify, defend and hold harmless Omari Group LLC and its members, managers, employees, agents and suppliers from any claim or demand, including reasonable attorneys' fees, made by a third party arising out of your breach of these Terms or of any law, or out of your infringement of the rights of a third party.
19. Term and termination
These Terms are effective while you use the Site. You may stop using the Site at any time. We may suspend or terminate your access to the Site at any time, with or without notice, if we believe you have breached these Terms. The obligations and liabilities incurred before termination survive it.
20. General
If any provision of these Terms is found unlawful, void or unenforceable, it will be enforced to the fullest extent permitted and the remaining provisions will stay in force. Our failure to exercise or enforce any right is not a waiver of that right. You may not assign these Terms without our written consent; we may assign them in connection with a transfer of our business. These Terms, together with the policies referred to in them, are the entire agreement between you and us in relation to the Site, and replace any prior agreement about the same subject matter. Any ambiguity in these Terms will not be construed against the drafting party.
21. Governing law and venue
These Terms and any separate agreement by which we provide you products are governed by the laws of the State of Florida, without regard to its conflict of law rules. You and we agree that any dispute arising out of or relating to these Terms or to the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives you of the protection of any mandatory consumer law of the state in which you live.
22. Changes to these Terms
We may update these Terms at any time by posting the updated version on this page and changing the "Last updated" date. The version in force when you place an order applies to that order. Your continued use of the Site after we post changes means you accept them.
